General

 

 

Domino Polska Spółka z ograniczoną odpowiedzialnością with its registered office in Dzierżoniów , 4 Rzeźnicza Street, 58-200 Dzierżoniów , which is the owner of the Lavita brand (hereinafter: Guarantor or LAVITA), provides a guarantee for Products sold and used in the territory of Poland, which are in the commercial offer of the Guarantor to the extent referred to in this guarantee. This warranty does not affect in any way the effectiveness of generally applicable provisions of Polish law, particularly those concerning liability for the Product or warranty provisions. The holder of this warranty may exercise rights under the warranty for physical defects of the Products independently of the rights under this warranty. This warranty is granted to the end users of the Products, hereinafter referred to as Consumers, i.e. entities that purchased the Product to satisfy their own needs; they did not purchase the Product for resale, for their professional or business activity.

 

 

 

Declaration of guarantee

 

 

* The Guarantor confirms the conformity of the Products with the marking and intended use, provided that their assembly and use, including regular maintenance and care of the Product, are in accordance with the rules and requirements set forth in the assembly instructions , provided to the Consumer with the Product and available on the website of the Guarantor, i.e. www.lavita.pl. The Guarantor shall be liable for defects in the Products revealed during their acceptance (before installation) or during the use of the Products, and resulting from manufacturing errors, design or improper quality of materials used in their manufacture.

 

*Consumer is obliged to check the completeness of the Product and the absence of damage and visible defects of the Product at the time of receipt, before installation. In the case of built-in flush-mounted frames, also irregularities in the operation of the Product must be reported before its installation. If damages and defects of the Product are found after its installation, excluding hidden defects, the Consumer shall bear the costs of assembly and disassembly of the Product (e.g. costs caused by forging of tiles).

* The Product should be installed in such a way that it is possible to dismantle it without damaging other equipment; the Guarantor shall not cover the costs associated with the repair or replacement of such equipment. Work related to ensuring free access to the Product (disassembly, removal of buildings, covers, etc.) must be carried out prior to the commencement of warranty activities, by the Consumer and at his expense.

 

*Guarantor declares that the Products have been approved for marketing and general use in the construction industry in accordance with the legal requirements in force in Poland. The color of Products from the same collection may differ slightly and appear in similar shades, which does not constitute a defect in the Product, but results from the normal production process.

 

 

 

Warranty period

 

 

The warranty period is calculated from the date of purchase of the Product by the Consumer.

Products covered by the warranty:

1) Bathtubs : 10-year warranty protection covering defects caused during the manufacturing process; the warranty does not cover subsequent changes, mainly any kind of changes occurring in the surface layer and air bubbles on the bottom of the Products.

2). White ceramics: 15-year warranty protection for the preservation of the color of the glaze, non-occurrence of surface cracking of the glaze; the warranty does not cover parts manufactured from other materials, such as duroplast toilet seats.

3) Colored ceramics: 2-year warranty protection for the preservation of the color of the glaze, non-occurrence of surface cracking of the glaze; the warranty does not cover parts made of other materials, such as duroplast toilet seats.

4) Concealed racks for 40,50 cm toilet bowl: 10-year warranty protection for powder-coated steel frame, polyethylene tank;; 2-year warranty protection for flush buttons; 2-year warranty protection for drain valve, filling valve, connections, braided hose, plastics; the warranty is valid only if the Products have been installed in accordance with the instructions and the art of construction. irregularities in the operation of the Product must be reported before installation. If the damage and defects of the Product are found after its installation, excluding hidden defects, the Consumer shall bear the costs of installation and removal of the Product (e.g. costs caused by forging tiles).

 

* The Product should be installed in such a way that it is possible to dismantle it without damaging other equipment; the Guarantor shall not cover the costs associated with the repair or replacement of such equipment. Work related to ensuring free access to the Product (disassembly, removal of build-ups, covers, etc.) must be carried out before the start of warranty activities, by the Consumer and at his expense.

 

*Guarantor declares that the products have been approved for marketing and general use in construction in accordance with legal requirements in force in Poland. The color of Products from the same collection may differ slightly and appear in similar shades, which does not constitute a defect in the Product, but results from the normal production process.

 

 

 

Claim notification

 

 

 

Before filing a claim, the Consumer is obliged to check whether the defect did not arise as a result of improper transportation or storage, as well as inconsistent with the Manual: installation, use, maintenance or care.

Any defects in the Product arising during the warranty period should be reported by the Consumer to the Seller, or directly to the Guarantor, in the form of an appropriate complaint letter or in any other manner permitted by law, containing a detailed description of the defect. In the situation of reporting a complaint directly to the Guarantor, the Buyer may send the notification to biuro@lavita.pl. In order to eliminate any doubts, the Buyer is obliged to indicate in the notification whether he is filing a complaint under the warranty or under any other title.

 

The Consumer is obliged to report detected defects in the Product immediately after their disclosure, but no later than within 2 months from the disclosure of the defect, under pain of loss of rights under the Guarantee. The notification should indicate the Consumer's contact information, the place of installation of the Product, a detailed description of the detected defect and the circumstances of its discovery, and possible photographic documentation, if the situation requires it. Along with the notification of the defect, a legible proof of purchase of the Product must be attached. The Consumer, reporting a complaint, should not, unless expressly agreed with the Guarantor, return the defective Product to the Guarantor or disassemble it on their own.

 

 

 

Warranty services

 

 

 

 

DOMINO POLSKA will recognize the complaint within 14 days from the date of receipt of the application. If the complaint is recognized, the Guarantor, at its option, may:

(a) repair the defective Product,

(b) replace it

(c) agree to refund the purchase price of the Product by the seller who sold the defective Product to the Consumer.

 

 

 

Conditions and exclusions

 

 

 

The Guarantor's liability under the warranty is excluded in the event of:

1. natural wear and tear of consumable parts subject to periodic replacement in Products of a given type;

2. defects and damage caused by precipitation of sediment from the water used or damage caused by contamination of water or water supply pipes

3. mechanical damage to the Product caused by the user of the Product or third parties (scratches, dirt, bruises, etc.);

4. defects in the surface and coatings of the Product caused by improper care of the Product that is not in accordance with the rules set forth in the Instructions (in particular, in connection with the use of improper care agents for cleaning, such as sponges and scrubbing agents, cleaning agents containing solvents or acids - such as preparations for the removal of lime deposits, acetic acid and food vinegar - as well as other agents not intended for the care of the product group to which the Product belongs, such as strong alkalis and detergents);

5. defects in the Product resulting from the use, maintenance and care of the Product not in accordance with the rules set forth in the Manual;

6. defects resulting from installation inconsistent with the Instructions and the art of construction and inconsistent with the intended use, as well as those resulting from installation performed with equipment or materials inconsistent with the Instructions;

8. mechanical damage or defects of the Product arising during transport, handling and as a result of improper storage of the Product by the Consumer;

9. defects arising as a result of improper protection of the Product for the duration of construction work carried out by the Consumer (in particular, as a result of the use of improper protective materials, damage to coatings by contamination with mortar, plaster, paint, silicone, etc.);

10. insignificant defects, i.e. such defects that remain̨ invisible after installation of the Product or do not affect its value in usę;

11. minor deviations of the Product from the required characteristics that do not affect the use value of the Product (e.g., in the case of ceramic products);

12. defects arising as a result of temperature drops below 0 degrees Celsius in the room where the Product is installed or installation of the Product outside any building structure;

13. defects resulting from fortuitous events and natural disasters;

14. purchase of the Product:

-incomplete;

-exposure;

-at a reduced price, i.e. a Product that had defects due to which the price was reduced, of which the Consumer knew and agreed.
